GENERAL TERMS AND CONDITIONS OF SALE (GTCS)<\/h1>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

Article 1 \u2013 Purpose and Scope<\/h2>

These General Terms and Conditions of Sale govern the concierge, coordination, orientation, assistance, and accompaniment services offered by ALLIANCE LUXCARE.<\/p>

The precise content of each mission is determined in the quote accepted by the Client.<\/p>

ALLIANCE LUXCARE acts exclusively as an intermediary, coordinator, and companion.<\/p>

ALLIANCE LUXCARE is neither a healthcare facility nor a healthcare professional and does not perform any medical acts.<\/strong><\/p>

Article 2 \u2013 Nature of Services<\/h2>

Depending on the Client’s needs and the services provided for in the quote, ALLIANCE LUXCARE may notably provide:<\/p>

\u2013 research and orientation towards healthcare facilities or professionals;
\u2013 connecting with the relevant stakeholders;
\u2013 coordination of the different stages of care;
\u2013 administrative and logistical organization;
\u2013 personalized accompaniment;
\u2013 coordination of appointments;
\u2013 assistance in organizing travel and stays related to care;
\u2013 coordination of international medical transport through an authorized provider;
\u2013 more generally, any concierge and coordination service expressly provided for in the quote.<\/p>

Article 3 \u2013 Absence of Medical Practice<\/h2>

ALLIANCE LUXCARE does not perform any diagnosis, consultation, prescription, treatment, act of care, or therapeutic decision.<\/p>

All decisions relating to diagnosis, treatment, health status, and medical care of the Client fall exclusively under the responsibility of the competent doctors, professionals, and healthcare facilities.<\/p>

The information communicated by ALLIANCE LUXCARE as part of its services does not constitute medical advice.<\/p>

Article 4 \u2013 Independence<\/h2>

ALLIANCE LUXCARE does not have any exclusive contractual partnership with the healthcare facilities or professionals to which a Client may be oriented, unless express information to the contrary is communicated to the Client.<\/p>

Orientations are carried out independently based notably on the Client’s request, the specialization sought, availability, and relevant qualitative and organizational criteria.<\/p>

Article 5 \u2013 Third-Party Providers<\/h2>

Doctors, healthcare facilities, clinics, hospitals, laboratories, medical transporters, airlines, hotels, drivers, interpreters, and other stakeholders are legally independent providers from ALLIANCE LUXCARE.<\/p>

Each provider remains responsible for the execution of its own services, decisions, and obligations.<\/p>

ALLIANCE LUXCARE remains responsible for the execution of its own coordination obligations under the conditions provided for by the applicable regulations.<\/p>

Article 6 \u2013 Quote and Conclusion of the Contract<\/h2>

Paid services are subject to a quote specifying notably their nature and price.<\/p>

The contract is concluded upon acceptance of the quote by the Client according to the terms indicated therein.<\/p>

Acceptance of the quote implies acceptance of these GTCS.<\/p>

Article 7 \u2013 Rates and Payment<\/h2>

The applicable rates are those appearing on the quote accepted by the Client.<\/p>

Unless otherwise stipulated in the quote:<\/p>

a 50% deposit is due upon acceptance of the quote.<\/strong><\/p>

The balance is payable according to the conditions and deadlines indicated in the quote.<\/p>

ALLIANCE LUXCARE’s fees correspond to its own concierge, coordination, and accompaniment services.<\/p>

They are distinct from the fees and costs invoiced by doctors, facilities, transporters, accommodations, and other third-party providers.<\/p>

VAT is applied in accordance with the tax provisions applicable to the transaction concerned.<\/p>

Article 8 \u2013 Right of Withdrawal<\/h2>

When the contract is concluded remotely or off-premises with a consumer Client and the legal conditions are met, the Client benefits from a period of fourteen (14) days from the conclusion of the contract<\/strong> to exercise their right of withdrawal.<\/p>

When the Client wishes the execution of the service to begin before the expiration of this period, ALLIANCE LUXCARE shall obtain their express request for early execution.<\/p>

If the Client exercises their right of withdrawal while execution has begun at their request, they may be required to pay the amount corresponding to the services actually performed until the notification of their withdrawal, in accordance with applicable regulations.<\/p>

When the service has been fully performed before the expiration of the withdrawal period, the right of withdrawal may be lost under the conditions provided for by law, notably after the Client’s prior express agreement and acknowledgment of the loss of their right after full execution.<\/p>

Article 9 \u2013 Cancellation or Modification<\/h2>

Any request for cancellation or modification of the mission must be addressed in writing to ALLIANCE LUXCARE.<\/p>

When the execution of the mission has already begun, the services actually performed and the costs incurred and non-recoverable may remain due, subject to the mandatory provisions applicable to the consumer Client.<\/p>

The cancellation conditions of third-party providers are those established by the latter.<\/p>

Article 10 \u2013 International Medical Transport<\/h2>

When international medical transport is organized, ALLIANCE LUXCARE acts exclusively as an intermediary and coordinator.<\/p>

Transport is carried out by an authorized provider who remains responsible for its medical, operational, and technical organization.<\/p>

ALLIANCE LUXCARE decides neither on the medical fitness for transport nor on its clinical modalities.<\/p>

Article 11 \u2013 Obligation of Means and Absence of Medical Guarantee<\/h2>

ALLIANCE LUXCARE is bound by an obligation of means in the execution of its own services.<\/p>

In particular, it does not guarantee:<\/p>

\u2013 the acceptance of a file by a professional or facility;
\u2013 the availability of a professional or facility;
\u2013 a precise timeframe for care;
\u2013 obtaining an appointment on a specific date;
\u2013 a particular medical decision;
\u2013 the effectiveness of a treatment;
\u2013 a therapeutic result;
\u2013 the absence of medical complications.<\/p>

Article 12 \u2013 Liability<\/h2>

ALLIANCE LUXCARE is liable for damages directly attributable to it due to a fault in the execution of its own obligations, in accordance with applicable law.<\/p>

ALLIANCE LUXCARE cannot be held responsible for medical decisions or acts of care falling under healthcare professionals, nor for breaches directly attributable to legally independent third-party providers.<\/p>

No provision of these GTCS shall have the effect of excluding or limiting liability when such exclusion or limitation is prohibited by law.<\/p>

Article 13 \u2013 Insurance<\/h2>

ALLIANCE LUXCARE declares that it has professional liability insurance adapted to its activity.<\/p>

Article 14 \u2013 Confidentiality<\/h2>

ALLIANCE LUXCARE undertakes to preserve the confidentiality of the information communicated as part of its services, subject to the transmissions necessary for the execution of the mission and carried out in accordance with applicable regulations.<\/p>

Article 15 \u2013 Force Majeure<\/h2>

Neither party may be held responsible for a failure resulting from an event meeting the conditions of force majeure within the meaning of Article 1218 of the Civil Code.<\/p>

Article 16 \u2013 Consumer Mediation<\/h2>

After a prior written complaint to ALLIANCE LUXCARE and in the absence of a satisfactory response, the consumer Client may resort free of charge to the mediator:<\/p>

Article 17 \u2013 Applicable Law and Dispute Resolution<\/h2>

These GTCS are subject to French law.<\/p>

When the Client is a consumer residing abroad, this stipulation does not deprive them of the mandatory protective provisions from which they might benefit under the applicable law.<\/p>
